- SCOPE OF THE TERMS AND CONDITIONS
- These terms and conditions (hereinafter – Terms) regulate legal relationship between Trivial OÜ, (hereinafter – Trivial, we, us our) and any person (hereinafter – Client, you) who uses our website https://trip1.com (hereinafter – Website) and/or Services (as defined hereinafter in these Terms) through the Website.
- Using the Website and/or Services shall be subject to these Terms. By using the Website and/or Services you acknowledge your understanding and agree to be legally bound by these Terms, together with any other set of rules (policies, annexes etc.) referred to in the Terms, as updated and amended from time to time. Furthermore, should you order Services hereof on behalf of other person(s) you shall be taken to have the authority to agree to these Terms on behalf of any other person(s).
- The Terms are standard, that is, prepared by Trivial in advance for general multiple use, not harmonised with another party, and incontestably applicable to legal relations between Clients and Trivial unless the certain contract clearly stipulates otherwise. If you do not understand Terms or if they partially or entirely are unacceptable for you, you are not entitled to access or use the Website and/or any Services ordered/rendered through them.

- DEFINITIONS
- The following capitalized definitions when used in these Terms shall have the following meanings:
- Booking means the process of purchasing Travel Products and the resulting outcome of this process (e.g. choice of product, acceptance of terms and conditions, and/or confirmation of booking). A Booking is deemed to be completed in accordance with the rules established by relevant Travel Product Provider. In no event mere payment of relevant Booking shall mean the confirmation of it by the relevant Travel Product Provider.
- Client means any person who uses Services through the Website. In some provisions of these Terms, the term “Client” is replaced by the pronouns “you”, “yours” having the same meaning.
- Intellectual Property Rights include all present and future copyright, all proprietary rights in relation to inventions (including patents), registered and unregistered trademarks, confidential information (including trade secrets and know how) designs, circuit layouts, and all other proprietary rights resulting from intellectual activity of the industrial, scientific, literary or artistic fields whether registered or not and whether capable of registration or not.
- Services means the booking facilitation services provided by us through the Website in accordance with these Terms that enables you to purchase Travel Products. The Services we provide are: (i) providing information about Travel Products on the Website; (ii) running of Website functionalities that enable you to use Services to book and purchase Travel Products; (iii) facilitation of conclusion of the contracts between you and relevant Travel Product Provider (where applicable); (iv) delivery of Booking confirmation resulting from your Booking.
- Travel Products mean services and products related to travels (such as flight, hotel reservations, trips and others), except organized tourist trips. List of available Travel Products is provided on our Website.
- Travel Product Provider means any third party responsible for delivering the goods and/or service(s) purchased by Trivial for you. For the avoidance of doubt, where a Booking involves multiple Travel Product Providers, each Travel Product Provider is to be taken as a separate entity responsible only for the provision of their respective part(s) of the goods and/or service(s) under the Booking.
- Trivial means Trivial OÜ the private limited liability company incorporated under the laws of the Republic of Estonia, registry code 17314412, registered place of business at Harju maakond, Tallinn, Kesklinna linnaosa, Tartu mnt 67/1-13b, 10115, email: hello@trip1.com. In some provisions of these Terms, the term “Trivial” is replaced by the pronouns “we”, “us”, “our” having the same meaning.
- Website means website https://trip1.com including all its sub-domains that is operated and administered by Trivial.
- Where required by the context, the definitions used in the singular form in the Terms shall be deemed to include their plural form and vice versa.
- TRIVIAL ROLE
- You acknowledge your understanding that Trivial acts as an intermediary facilitating Bookings with Travel Product Providers, i. e. Trivial does not act as an agent for the Travel Product Providers and is neither seller nor reseller of any Travel Product and is not a party to the Travel Product purchase agreement concluded through the Website.
- While we endeavour to select reputable Travel Product Providers, we do not own or control any of the Travel Products offered on our Website. Any Booking made with our help (through the Website) is subject to the terms and conditions of the Travel Product Provider(s) responsible for delivering that/those Travel Product(s). These terms and conditions may be made available to you upon request. You accept that if there are issues with the provision of your Travel Product(s), or if the Travel Product Provider otherwise fails to meet its contractual obligations, your legal recourse lies with the relevant Travel Product Provider, and Trivial will not be liable.
- For avoidance of doubt, Trivial does not combine Travel Products into a package within the meaning of Directive (EU) 2015/2302. Where applicable, acquiring of Travel Products through us may constitute linked travel arrangements, in which case Trivial acts solely as a facilitator and provides the statutory information required by applicable laws.
- You acknowledge that these Terms are separate from any terms, conditions, or agreements that you may directly or through us enter into with the Travel Product Provider(s) responsible for the fulfilment of Travel Product you purchase through us.
- You accept and acknowledge that our Services are not financial services or virtual asset services and Trivial is not regulated or licensed as provider of those services.
- We reserve the right to limit the availability of certain Travel Products to specific languages and to exclude certain products from eligibility for rewards or incentives at our sole discretion.
- REPRESENTATIONS AND WARRANTIES
- By using our Website and/or Services, you:
- confirm that you are eligible to enter into and be bound by these Terms as well as to purchase Travel Products;
- confirm that you have read, understood and agree with these Terms and other rules and regulations related to Travel Products you are purchasing;
- commit to be bound by these Terms;
- confirm your understanding that Trivial is neither seller nor reseller of any Travel Product, nor an agent of any Travel Product Provider and assumes no liability neither for execution of Travel Product purchase transactions nor for any seller’s obligations arising from such transactions (exchange, redeem, refund or otherwise compensate Travel Product purchased through us), unless otherwise provided by applicable laws;
- understand that you are solely responsible for determining the suitability, risks and appropriateness of Travel Product you purchase;
- understand that any advertising material of Travel Product may vary from the real appearance of it;
- confirm that source of funds used by you to purchase a Travel Product are owned by you and are derived from legitimate sources;
- confirm that Trivial has not advised you, nor individually recommended to you to purchase a certain Travel Product, not excluding any advertisement of possibility to purchase Travel Products through the Website;
- confirm your understanding that legal requirements vary worldwide, and it is your responsibility to make sure that you comply with any and all local regulations, directives, restrictions and laws in appropriate place of residence before purchasing any Travel Product through the Website;
- you are not, directly or indirectly, subject to economic sanctions.
- We do not warrant that purchased Travel Product will be continuously available or delivered in a timely manner or at all. Consequently, you agree and accept that all Travel Products and all related information are provided on an “as is” and “as available” basis without warranty of any kind, express or implied from our side.
- We make every effort to offer our clients best options though we do not warrant that the Travel Products purchased through the Website, including those provided in the exemplary list, will meet your requirements. Any relations regarding use/withdrawal/redemption of Travel Product purchased through the Website are exclusively between you and the relevant Travel Product Provider as well as all complaints regarding use/withdrawal/redemption of Travel Product purchased through the Website shall be directed exclusively to the relevant Travel Product Provider only.
- Considering that Trivial is not an agent for any Travel Product Provider, nor the or neither reseller of any Travel Product, we are not in a position to exchange, redeem, refund or otherwise compensate Travel Products purchased through us. Nevertheless, we can provide certain help claiming such demands to relevant Travel Product Provider subject to separate agreement with you.
- To the fullest extent permissible by law, we make no representations, warranties or conditions of any kind, express or implied, with respect to Travel Products, including without limitation, any express or implied warranty of fitness for a particular purpose, title, or non-infringement, or any warranty arising by usage of trade, course of dealing, or course of performance.
- You accept that you are solely responsible for ensuring that all information provided by you to us during the Booking process is complete, legitimate, accurate and up to date, relating but not limited to, passenger details, travel dates, departure points, transit points and destinations. You further accept that we shall bear no liability for any illegitimacies, inaccuracies or deficiencies in the information provided, and that it is your sole responsibility to verify the legitimacy, accuracy and completeness of any documents you receive from us in relation to your Booking.
- USING THE SERVICES
- Wishing to book a certain Travel Product through us you must submit a relevant form of order on the Website.
- Upon receipt of your order we shall promptly check if the order can be fulfilled (whether appropriate Travel Product is available). We reserve the right on our own discretion to accept or to reject your order. Confirmation of your order together with the relevant information related to Travel Products booked and instructions for payment of the Booking will be sent to you electronically to the email address provided by you or otherwise providing relevant information to you on the Website. You may be redirected to the website of the relevant payment service provider to pay for your Booking.
- After successful payment your Booking confirmation will be delivered to you electronically to the email address provided by you. You acknowledge that it is your responsibility to ensure that the email address you provide is entered correctly and agree to notify us immediately upon becoming aware of any error in the details entered or provided during a Booking. We shall not be liable for any delay or failure to deliver your Booking confirmation where such delay or failure is due to fault on your side.
- The Travel Product Provider or other relevant authorities may require you to present any of the following documents in either electronic or printed format: your itinerary/e-ticket(s), boarding pass(es), visa(s), passport, and/or any other relevant travel document. You are solely responsible for presenting such documents.
- Certain conditions or restrictions may be imposed on Booking confirmation(s) by Travel Product Providers, such as being non-refundable or subject to change fees or cancellation fees. You accept that it is your responsibility to carefully review each Booking confirmation and any attached documents upon receipt, to ensure that the details are accurate, and that you accept the conditions or restrictions associated with each Booking.
- Some Travel Products are not transferable and requires identification of purchaser and/or end user of it. It is your responsibility to ensure that the details on your Booking confirmation are correct and accurate. This includes confirming that the name, date of birth, and document number for all persons are correct.
- In some cases, the price of a Travel Product may change between the time that you select the Travel Product and the time the Booking confirmation is issued. If a change of this nature occurs, we may not be able to ensure that you are notified of or aware of such changes in prices. However, we may provide you with a refund of your Booking in accordance with Clause 6.6. Notwithstanding, you accept that we are under no obligation to provide you with reimbursement of any kind if the price of a Travel Product changes between the time that you select the Travel Product and the time the Booking confirmation is issued.
- Any health requirements associated with your Booking as well as visas and other travel documents are your sole responsibility. You have to take care of having relevant health or vaccination documentation (if required), obtaining visas and other travel documents.
- Trivial assumes no liability for the theft, misuse, or loss of Booking after delivery hereof, unless our gross negligence or wilful misconduct will be established. You must comply with any separate terms issued by the certain Travel Product Provider.
- CHANGES, CANCELLATIONS AND REFUNDS
- The applicable cancellation policy of the Travel Product may be displayed prior to your completion of the online Booking process or in the Booking confirmation. Please ensure that you carefully read and accept the cancellation policy applicable to your selected Travel Product as the cancellation policy may vary between Travel Product Providers and the respective Travel Products that are offered. You acknowledge that any cancellation of a Booking shall be subject to these Terms as well as the respective Travel Product Provider cancellation terms/policies and may be subject to cancellation fees.
- You acknowledge that Trivial role is as an intermediary in purchasing Bookings with Travel Product Providers. Accordingly, while certain Travel Product Providers may offer a penalty-free cancellation or 'void' period, you understand and agree that applying this policy to Bookings made via the Website is subject to operational constraints. All cancellation requests must be submitted to us for processing before they can be transmitted to the relevant Travel Product Provider. Due to this necessary communication and processing time, we do not guarantee that a cancellation request will be actioned by the Travel Product Provider within their applicable grace period.
- You acknowledge and agree that some Bookings may be non-refundable. In such cases we are unable to provide you with a refund. Where you request for voluntary cancellation of a Booking that may be refundable, please be aware that we nevertheless require time to review with the Travel Product Providers and thus cannot be immediately certain of the refund amount that you may receive.
- You acknowledge and agree that we do not guarantee that any requested cancellation or change to a Booking will be effective as effectiveness of any cancellation or change is subject to the policies of the respective Travel Product Provider(s). You accept that we shall not be liable for any failure or delay in processing such cancellations or changes, or for any consequences that may arise as a result of such failure or delay, including but not limited to forfeited payments or lack of availability of alternative arrangements.
- If your Booking is cancelled or changed by the Travel Product Provider, we will utilise reasonable efforts to notify you of the corresponding cancellation or change as soon as practicable. You accept that we shall not be liable for such cancellations or changes as well as any consequences that may arise in connection with such cancellations or changes, including any associated cancellation fees or change fees.
- In an event you acquire right for a refund the relevant amount that you are eligible for will be processed upon our receipt of cleared assets from the relevant Service Provider. You acknowledge and agree that we reserve the right to require you to comply with our compliance requirements before processing any refund. If we notify you of such a requirement, we will be under no obligation to process your refund until such compliance requirements have been completed to our satisfaction. Where a refund is due to you, and/or we have received your cancellation or amendment instructions, we may, at our sole discretion, issue the refund to your credit card or debit card after we have received the applicable refund sum from the respective Service Provider.
- PAYMENTS
- The price displayed for your Booking is indicative and subject to confirmation, and we will only process your Booking upon receipt of full payment of the total price of that Booking. Please note that as relevant taxes are subject to change, they are only finalised when your Booking confirmation is issued. A Booking may be cancelled without any negative consequences for us and/or Travel Product Provider and without any advance notification in the event where relevant payment service provider cancels, annuls or chargebacks your relevant payment.
- A payment shall be deemed received only once it has been successfully authorized, settled, and confirmed by the relevant Travel Product Provider’s payment service provider. You acknowledge that payment processing may involve third-party systems and compliance checks, which may cause delays, temporary holds, rejections, or reversals. Trivial shall not be liable for any Booking cancellation, price change, or loss of availability resulting from delays or failures in payment authorization or settlement that are beyond Trivial’s direct control.
- In the event that a confirmed Booking made through the Website and paid by you through us is unfulfillable due to our fault, the full amount paid will be refunded to the same account from which the payment was made.
- Payment in cryptocurrencies. You agree that each purchase or payment of a Booking with digital assets or cryptocurrencies initiates a transfer of legal and beneficial ownership of such digital assets or cryptocurrencies from you to Trivial or our affiliated and related entities. However, you acknowledge and agree that such transfer of ownership is conditional upon the transaction satisfying our compliance requirements. Should the purchase or payment fail to satisfy our compliance requirements, we reserve the right to refuse to accept your payment, and in such cases, the assets may be frozen or withheld for as long as we deem necessary in our sole discretion to satisfy our compliance requirements, conclude any related investigation, or comply with instructions from any competent court, law enforcement, or regulatory authority. Only upon successfully satisfying our compliance requirements shall ownership of the digital assets or cryptocurrencies be deemed fully transferred to Trivial or our affiliated and related entities, which shall then, at our sole discretion, become the legal and beneficial owner of such digital assets or cryptocurrencies. You acknowledge that while Trivial allows Clients to make payments for Bookings and/or Services using digital assets or cryptocurrencies, Trivial does not accept and process payments on your behalf for its goods or services, and that the market value of digital assets and cryptocurrencies are inherently volatile. You accept that it is your responsibility to ensure that payment is completed correctly and in a timely manner, and we shall not be liable for any losses due to delays or errors in the transaction process.
- We reserve the right to alter terms of payment in our sole discretion.
- You acknowledge your understanding that certain transactions may fall under payment services or e-money regulations. You agree to comply with all applicable laws, and we may impose extra measures if needed to satisfy regulatory requirements.
- It is your solely responsibility to ensure payment of all taxes, assessments, tariffs, duties or other fees imposed, assessed or collected by or under the authority of any governmental body (collectively, “Taxes”) arising from the Booking and/or purchase of any Travel Product through the Website and/or using of any Travel Product, including applicable local taxes, payable on the spot, including in cash.
- Relevant invoices for the payments shall be accessible for you through the relevant access link sent to your e-mail address.
- You agree that our affiliated and related entities, or third-party payment service providers may securely store your payment details, which may subsequently be used for any payments or refunds associated with your Booking(s). You accept that by submitting your Booking details, you authorise us to facilitate reservations on your behalf, including making payment arrangements with the Travel Product Provider(s) related to the facilitation and execution of your Booking.
- You agree that if action is taken to enforce monies due under this agreement, Trivial shall be entitled to receive all costs of collection including all court costs and legal and attorney’s fees.
- OBLIGATIONS AND RIGHTS OF THE PARTIES
- We undertake to use our best efforts to perform our duties to you on the conditions most advantageous to you and without undue delay. You acknowledge your understanding that prices of Travel Products may change at any time, and Trivial in no event provides price protection or refunds in the event of price reduction after purchase of relevant Travel Product.
- We assume no liability towards Clients for the failure of a Travel Product Provider to perform a Travel Product purchase agreement.
- You undertake not to use our services and/or Website for purposes and/or activities that may harm Trivial’s brand and image, or for morally or ethically dubious purposes, or purposes which might violate applicable laws and regulations.
- You undertake to respect Intellectual Property Rights of Trivial and/or third parties.
- You acknowledge your understanding that you are solely responsible for keeping codes, passwords and related online access credentials related to your Trivial Account secure. You further agree to regularly rotate any access keys to minimize security risks.
- REGULATORY AND LEGAL COMPLIANCE
- Trivial seeks to comply with all relevant laws and regulations.
- In addition, by using our services, you may be asked to provide additional information and/or documents that enable us to verify your (and/or persons, on behalf of which you are acting) identity. From time to time, we shall perform additional reviews of transactions, that are required due to banking partners’ additional due diligence. We shall provide prompt notice to you if additional action from your part is needed. In order to use our services, you agree to cooperate with our information requests for such additional information when additional documentation is required. If you fail to provide the required information, we may be unable to complete transaction. We assume no responsibility for such a transaction failing.
- We reserve the right to verify information provided by you using reliable and independent sources of information and other lawful methods.
- We shall perform monitoring of your purchases of Travel Products through the Website and in a case of suspicious and/or unusual purchases, shall have the right to reject them. In that case, we shall not be liable to you for any default on any obligations and/or for any damages or losses sustained by them.
- SECURITY MEASURES
- It is your sole responsibility to keep the unique codes/identifiers constituting digital access to Travel Product purchased by you safe. If you pass on such unique codes/identifiers to any third party, lose them or such information becomes otherwise accessible to any third party, you are fully responsible for any possible adverse consequences. Trivial assumes no responsibility for your loose, destruction and/or unlawful usage of your access to Travel Product.
- DEVELOPMENT AND MODIFICATION OF TRIVIAL’S SOFTWARE. SUPPORT
- Trivial reserves the right to exercise its discretion at any time to develop, improve, and otherwise modify Website and/or the applications comprising our systems or other programs related to purchasing and/or using our services through it, the functions and functionality of Website and/or systems, including, but not limited to: quantity of functions (by both increasing and decreasing it), their scope (by both increasing and decreasing it), procedure for use of the functions, scope of data required for Client’s identification and identification procedures etc. If needed and possible, at our discretion we shall publish information about the changes indicated in this clause on the Website. We assume no responsibility for any losses and inconveniences to a Client and/or any third parties, which may be sustained as a result of exercising our right indicated in this clause, or we are released from such responsibility.
- Trivial has a professional support team for technical service questions available from 10:00 to 17:00 on business days. The Support Team is available via support@trip1.com.
- INTELLECTUAL PROPERTY RIGHTS
- Trivial does not assume any obligations and/or responsibilities regarding any third party’s intellectual property related to Travel Products.
- Client acknowledges and agrees that the purchase of a Travel Product through the Website may provide the Client with access to various documents, processes, software and other technologies and materials, to which we and/or one or more third parties related with us will hold all intellectual property rights, including (a) copyrights, rights affording protection similar to copyright, rights in databases, patents and rights in inventions, trademarks, rights in internet domain names and website addresses and other rights in trade names, designs, know-how, trade secrets and other rights in Confidential Information, including under marketing legislation; (b) all other rights having equivalent or similar effect in any country or jurisdiction in the world (collectively "Intellectual Property Rights ").
- All copyrights, trademarks, patents, trade secrets and other Intellectual Property Rights relating to the purchase of any Travel Product, including API, systems, platforms, software and documentation provided by us to you are the property of Trivial and/or the third party which granted Trivial the right to provide/supply them, shall remain at all times the sole and exclusive property of Trivial or the relevant third party, and you will have no right or interest in them except for the right to access and use them in order to purchase and/or use our services through the Website under these Terms.
- DATA PROTECTIONS
- Trivial represents that the servers that maintain personal data obtained from Client, or on its behalf, are owned and managed by Trivial and will remain in the jurisdiction, and within the geographical limits of the European Union. Trivial further represents that personal data shall not be hosted, stored, or transferred outside of the European Union.
- TAXES
- It is Client’s own responsibility for paying any taxes applicable to Client in relation to purchasing and/or using of a Travel Product (including but not limited any municipal and/or hotel taxes charged at check-ins) and/or our services.
- In case Trivial is obliged under applicable law or voluntarily decides to report to any competent authorities any information that is related with a Client’s tax obligations, the Client undertakes to provide Trivial with the requested documents, data and information.
- MARKETING
- Client acknowledges and agrees that Trivial may include the Client’s name, trademarks (upon mutual agreement of a trademark licence) and a description of the services provided to the Client by Trivial, in case study marketing content, lists of or references to any of Trivial’s clients on its website and/or in proposals, and in other marketing materials. Client may withdraw their consent, in whole ir in part, at any time by providing us with a written notice.
- PROMOTIONS AND INCENTIVES
- Trivial may, from time to time, offer promotions, discounts, referral bonuses, loyalty rewards, travel credits, or other incentives (“Promotions”). Promotions are subject to these Terms unless otherwise specified in the applicable promotional conditions. In the event of any inconsistency between these Terms and the terms governing a specific Promotion, the terms of the specific Promotion shall prevail.
- Nature of Promotions. Unless expressly stated otherwise, Promotions: (i) have no monetary value; (ii) are non-transferable; (iii) cannot be exchanged for cash, digital assets, cryptocurrencies, or any other form of consideration; (iv) may be subject to expiry dates, usage limits, minimum spend requirements, or other conditions specified in the applicable Promotion.
- Non-Combination. Promotions may not be combined with other promotions, discounts, offers, credits, or incentives unless expressly stated otherwise in the applicable promotional terms.
- Eligibility and Legal Compliance. Participation in any Promotion is void where prohibited by applicable law. By participating in a Promotion, you represent and warrant that your participation is lawful in your jurisdiction of residence and does not violate any applicable laws or regulations. Trivial reserves the right to verify eligibility and compliance with Promotion conditions and to disqualify any participant where reasonably necessary to ensure compliance with applicable law or to protect the integrity of the Promotion.
- Abuse and Misuse. If Trivial reasonably determines that a Promotion has been misused, including but not limited to fraudulent activity, artificial or speculative Bookings, abuse of referral mechanisms, repeated cancellations designed to exploit a Promotion, or other conduct undermining the integrity or fairness of the Promotion, Trivial may, to the extent permitted by applicable law: (i) revoke or forfeit the relevant Promotion or associated benefits; (ii) cancel related Bookings; (iii) suspend or restrict your access to Promotions and/or Services.
- Cancellation and Forfeiture. Where a Promotion has been applied to a Booking and that Booking is subsequently cancelled, refunded, reversed, or otherwise invalidated for any reason, the value of the Promotion may be forfeited unless expressly stated otherwise in the applicable promotional terms.
- Modification or Withdrawal. Trivial reserves the right to modify, suspend, or withdraw any Promotion at any time for operational, technical, regulatory, legal, or commercial reasons. Such modification, suspension, or withdrawal shall not affect Promotions already validly applied to confirmed Bookings, unless required by applicable law.
- LIABILITY AND INDEMNITY
- To the extent permitted by law, Trivial excludes all liability and responsibility for any losses, damages, costs or expenses, whether in tort (including negligence), contract, warranty, product liability or otherwise and whether direct, indirect, or consequential (including in connection with business interruption), which a Client or any other person may suffer or incur in connection with the Travel Product purchased through and/or with the help of Trivial, the use/withdrawal/redemption or inability to use/withdraw/redeem of a Travel Product purchased through and/or with the help of Trivial, or otherwise.
- Where and to the extent liability for breach or any implied warranty or condition, or otherwise, cannot be excluded (for example, where Client’s direct damages were caused by Trivial’s intent or gross negligence), Trivial’s liability to a Client is limited to the price of our services (giving rise to the claim for liability) Client paid to Trivial. The foregoing limitation of liability shall apply to the fullest extent permitted by law in the applicable jurisdiction.
- Trivial takes no responsibility for and will not be liable for any financial loss arising from the use/withdrawal/redemption or inability to use/withdraw/redeem of a Travel Product purchased through and/or with the help of Trivial, including, but not limited to, inability to use/withdraw/redeem of a Travel Product due to insolvency or cessation of activities or any issues with the systems of a respective Travel Product Supplier, systems hacks, servers failures or data loss, security of unique codes/identifiers constituting the purchased digital product, unauthorized access to, or alteration, theft or destruction of the relevant digital product, corrupted files or data, incorrectly constructed transactions or otherwise.
- Trivial does not provide any financial or legal advice in connection with the Travel Products. Trivial may provide information on the Travel Products’ price, use, etc., but it should not be considered as financial or legal advice and should not be construed as such. Any decision relating to Travel Products’ purchase is Client’s decision and Trivial will not be liable for any loss suffered in relation thereto.
- Without any limitation of other terms in these Terms, Client acknowledges that Trivial bears no liability for any damage, loss (including loss of profit), delay or failure to sell, process or deliver unique codes/identifiers constituting the digital access to Travel Product purchased by Client, in each case caused by or resulting from (directly or indirectly):
- any computer virus, spyware, scareware, Trojan horse, worms or other malware or cyber, phishing or spoofing attack that may affect your computer or other device.
- any other cause or condition beyond our reasonable control and/or depending on third parties.
- Client agrees to indemnify, release and hold harmless Trivial, its affiliates and any company under common ownership or control with Trivial or its affiliates as well as the officers, directors, Trivial’s representatives and employees of the foregoing, from any claim, liability, loss, expense or demand, including legal fees, related to a Travel Products purchased by Client through or/and with help of Trivial.
- AMENDMENTS TO THE TERMS
- Trivial reserves the right to amend in its own discretion at any time these Terms by publishing an updated text of the Terms on the Website.
- VALIDITY OF THE TERMS
- Should any provision of these Terms appear to be in conflict with mandatory law and therefore null and void, this shall not make all the Terms or the transactions concluded on the basis thereof null and void. In such a case we shall undertake to replace the null and void provision of the Terms with economically and legally nearest its equivalent.
- MISCELLANEOUS
- Waiver. Any failure or delay by any Party in exercising any right or remedy in one or many instances shall not prohibit a Party from exercising it at a later time or from exercising any other right or remedy.
- Effect. All provisions of transactions made on the base of these Terms which by their nature shall be intended to continue shall survive termination, including terms relating intellectual property restrictions and reimbursement of damages.
- Force Majeure. Neither party shall have any liability for any loss or damages caused by any of the following force majeure conditions; fire, floods, explosions, strikes, embargoes, power blackout, earthquake, volcanic actions, wars, water, the elements, labour disputes, riots, thefts, acts of God, acts of government, , acts or omissions of any carrier, failure of public utilities, or any other cause beyond the reasonable control of a party.
- Governing Law. These Terms and Conditions have been prepared with reference to the law of the Republic of Estonia. The Contracts of Commission and other agreements concluded on the basis of these Terms and Conditions and the legal relations resulting from or in relation to them shall be governed by the law of the Republic of Estonia.
- Dispute Resolution. Any legal disputes arising from or in relation to the agreements concluded based on these Terms and Conditions shall be handled at a court of the Republic of Lithuania according to the seat of Trivial.
- Notices. Any notice required under these Terms to be given by a Party shall be given in writing, in the English language, and shall be sent by e-mail, addressed to the other Party.
